Terms of Service

1. Acceptance of Terms

By downloading, installing, or using OurCouple ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

These Terms also apply to our website and waitlist registration.

2. Eligibility

You must be at least 16 years old to use OurCouple. By using the App, you represent and warrant that you meet this age requirement.

3. Description of Service

OurCouple is a private couples app that allows partners to:

• Share daily messages and photos of the day
• Capture and store shared moments and memories
• Create shared notes and lists
• Track important events and dates
• Sync couple events to your device calendar (Premium)
• Answer daily couple questions together
• Co-parent a virtual pet that grows with your relationship
• Track your couple streak

The App is intended for personal, non-commercial use only between two consenting people in a relationship.

4. Account Registration

To use the App, you must create an account using your email, Google, or Apple Sign-In. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with anyone other than your connected partner

5. Partner Connection

OurCouple allows you to connect with one partner. By inviting or accepting a partner connection, you acknowledge and agree that:

• Your shared content will be visible to your connected partner
• You have the consent of the person you are inviting
• You will not use this feature to harass or monitor anyone without their knowledge
• Either partner can disconnect at any time

6. User Content

You retain full ownership of all content you create or upload to the App. By using the App, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing our services to you and your partner.

You agree not to upload content that:

• Is illegal, harmful, threatening, or offensive
• Depicts minors inappropriately
• Infringes on others' intellectual property or privacy rights
• Contains malicious code, viruses, or harmful software
• Violates any applicable laws or regulations

We do not monitor or review your content, but we reserve the right to remove content that violates these Terms if brought to our attention.

7. Premium Subscription

OurCouple offers a premium subscription with additional features. By subscribing, you agree to:

• Pay the applicable fees through the Apple App Store or Google Play Store
• Automatic renewal unless cancelled at least 24 hours before the renewal date
• Manage and cancel subscriptions through your device's app store settings

Shared subscription: A single premium subscription covers both partners in a couple space. When either partner subscribes, both partners get full premium access. There is no need for separate subscriptions.

Prices may vary by region and are subject to change. Refunds are handled according to Apple App Store or Google Play Store policies. We do not process payments directly.

8. Device Permissions

The App may request access to certain device features. You can manage these permissions in your device settings at any time:

• Camera & Photo Library — to capture and share photos with your partner
• Notifications — to receive messages and reminders from your partner
• Calendar — to sync couple events to your device calendar (Premium feature, opt-in only)

Calendar sync only writes couple events to your calendar. The App does not read or access your existing calendar entries.

9. Privacy & Encryption

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

OurCouple uses encryption to protect your personal content. This means:

• Your messages, photos, notes, and moments are encrypted on your device by default
• Only you and your partner can decrypt this content
• We cannot access, read, or recover your encrypted data

9b. Analytics & Cookies

Our website and app use analytics tools to help us understand how our product is used and improve your experience. These tools collect anonymous usage data such as page views, feature interactions, and conversion events.

We use the following analytics services:

• PostHog — Product analytics for website and app. Data hosted in the EU.
• DataFast — Lightweight, privacy-friendly website analytics.

These services may use cookies or similar technologies to collect data. Analytics data is never linked to your encrypted content and cannot be used to read your messages, photos, or notes. You can opt out of analytics tracking by using your browser's "Do Not Track" setting or a browser extension that blocks tracking scripts.

10. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality or servers
• Reverse engineer, decompile, or disassemble the App
• Use the App to harass, stalk, abuse, or harm others
• Create multiple accounts or use the App if previously banned
• Use automated systems or bots to access the App

11. Intellectual Property

The App, including its design, features, code, and branding, is owned by OurCouple and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice. You may delete your account at any time through the App settings.

Upon termination, your right to use the App ceases immediately. Your data will be deleted according to our Privacy Policy.

13. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The App will be error-free or uninterrupted
• Any errors will be corrected
• The App will meet your specific requirements

We recommend keeping backups of important content. We are not responsible for any loss of data.

14. Limitation of Liability

To the maximum extent permitted by applicable law, OurCouple and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the App.

Our total liability for any claims related to the App shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless OurCouple from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of others.

16. Governing Law & Disputes

These Terms are governed by the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Paris, France.

If you are a consumer in the European Union, you retain any mandatory protections provided by the laws of your country of residence.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or sending an email. Continued use of the App after such notice constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
